1. Preliminary remarks

a) The following conditions are considered agreed upon between visitors and registered members (herein after referred to as „user“) of the International-Sports-Leagues.com website and the operator of the website (herein after referred to as„ISL“). Please read the following terms and conditions carefully.

b) The user of the website confirms to be at least 18 years old and to be fully contractually capable as well as to meet all other conditions required in his home country for using the services offered on this website.

c) ISL offers the user the participation in a eSports Poker-League and championship system.

2. Scope of services:

ISL organizes and hosts championships in Poker eSports. Within that framework, ISL operates games in different leagues, hosts cup competitions, divises game plans, evaluates the game results and creates tables.
a) In particular, the website publishes the game results, the state of the tables and game plans as well as introduces the individual players and teams. The website is available for 24 hours, 7 days a week with an availability of at least 95% over the calendar year. The ISL cannot be made liable for variations. Moreover, downtimes due to maintenance, software updates and server back ups as well as those time periods when the web server is not available due to technical or other problems beyond the control of ISL (force majeure, faults on the part of a third party) are exempt from this.

b) ISL chooses individual or all games (so-called „top games“) of the 1st, 2nd and 3rd Poker eSport-Poker League – possibly also from other leagues or competitions - according to its own discretion. It is intended to make these games on the „www.esport-poker.com“ website available for download or as a stream. The teams have no right to the rating as a top game. Except for the mentioned services, ISL provides no other services. In particular, the user will not be provided with the hardware and software required for playing the games, access to the Internet or other service provider services.

c) ISL reserves the right to postpone individual games or entire days of play without providing any reasons. The teams will be notified about a postponement as early as possible. ISL reserves the right to postpone the start of the season or to completely cancel the season; especially, if there is not a sufficient number of teams to ensure the efficient operation of the respective leagues. In this case, the registered teams will be refunded the participation fee unless the credit has been used for other areas of the ISL or an affiliated website. The ISL is not obligated to accept other teams for the operation of the games, if the available spaces in the respective leagues have already been taken.

3. Participation

The members are only entitled to participate in the league and championship system of the ISL after all documents required for the registered team members of the relevant teams as well as the participation fee of the team have been submitted to the ISL one week prior to the beginning of the season.

a) The user undertakes to abide by the rules for the respective leagues set up by the ISL. The rules can be viewed in the forum and/or the website of the ISL or they can be made available to the user upon request via the contact form.

b) The payment for the participation fee per season for each team in the amount of $ 50,-- must be made at PokerRoom.com.
The user undertakes to give all particulars required within the scope of the registration and use of the offer truthfully and to the best of his knowledge. The ISL gives no guarantee for the correctness of the information provided by the users and published on the website of the ISL.

The user undertakes to give notice to the ISL about changed circumstances such as his address or account information which may clearly be important for the provision of services by the ISL. The user undertakes to exclusively use original games of the respective maker and to abide by its conditions of participation such as the minimum age. A transfer of player and team accounts to third parties shall be excluded. During a season, a player may only play for the team in the ISL for which he has registered.
The ISL reserves the right to exclude a user and/or his entire team from the playing if he and/or the entire team has broken the rules of the respective league. Full particulars can be found in the rules. In the case of an exclusion, there will be no right to a refund of any participation fees that have already been paid.

c) Users who participate in leagues in the International-Sports-Leagues (International-Sports-Leagues.com, eSport-Poker.com, herafter LEAGUE) and, for this reason, make deposits at PokerRoom.com accept that their deposit cannot be used as a real money stake for Standard-Cash-Games offered at PokerRoom.com. The user therefore accepts that the above deposit is an administrative fee, which will be used for implementation of the LEAGUE. LEAGUE games are exclusively free of charge Poker games without a stake. Users who register for participation in the LEAGUE guarantee that no games will be played with real money stakes at PokerRoom.com if laws enforced in the country of residence prohibit such participation.

4. Impediments to performance

All ISL services including the top games that place on the server of the ISL will be provided only within the scope of the existing operational, organizational and technical possibilities. However, the ISL undertakes to keep his equipment required for the provision of his services operational. The ISL is not liable for interruptions or delays of services due to acts of nature beyond control or due to other events that make it impossible or unreasonably difficult for the ISL to provide its service. Events in the aforementioned sense include, for example, strikes, technical failures at the operators of poker platforms, failures of telecommunication equipment, telecommunication transmission routes or nets, failure of the power supply, natural disasters, acts of force by third parties, the improper and especially the excessive usage of the ISL website, the occurrence of computer viruses, official interventions or similar.

5. The use of poker software

The use of the poker software is subject to the general terms and conditions to be accepted for this site and related to the software. Accordingly, these general terms and conditions must be accepted separately .

6. Member account, password and security:

a) In the course of the registration, you will receive a unique nickname/user name and a password that you need to enter in order to be able to access the site or parts of the site. When asked to choose a user name, you assure not to provide a name that untruly identifies you as another person or that might violate the rights of a third party.

b) The ISL reserves the right to prohibit the use of user names that the ISL judges inappropriate. Moreover, the ISL reserves the right to terminate the membership at any time if a user has violated these general terms and conditions with his chosen user name or if he uses it in a way that the ISL judges inappropriate.

c) The user ensures and guarantees not to make his nickname/user name and the password known to any other person and not to provide any other person access to the site. The user shall make sure that links indicating to lead to pages on this site will actually do that. The user shall never log on to the ISL site without first checking whether the URL showing in the address bar of the browser ALWAYS starts as follows: www.esport-poker.com (URL’s such as ISL.com are NOT authorized by the ISL). The user shall hold the ISL harmless for all activities taking place via URL’s that do not start with www.esport-poker.com.

d) The user carries the sole responsibility for keeping his nickname/user name and the password secret and for all activities that take place involving his nickname/user name and password. Moreover, the user carries the sole responsibility for any unauthorized use of the registered e-mail address which may lead to another person having access to his nickname/user name and/or his password. Without any restrictions to the aforementioned, the use is responsible to keep his virus protection and firewall software up to date and to take appropriate measures in order to keep the nickname/user name secret.

e) In regards to additional password and account security, you shall accept the following:

The user immediately informs the ISL in case of any unauthorized use of the nickname/username or password or in case of any other security breach.

f) The user makes sure to log out of his account at the end of each session. Even if the user utilizes the automatic log-in function provided by the site, the user is liable and responsible for any unauthorized use of the site in whatever way until he has notified the site’s customer service by telephone about this unauthorized use and until his notification has been confirmed by the customer service via his registered e-mail address. The user shall hold the ISL harmless for all activities that take place via his account.

g) The user may end his membership at any time by sending an e-mail to the ISL and by meeting the following requirements:

h) The user shall send a message to the support service that includes his nickname/user name with the intention to end his membership.

i) The user shall pay for possible outstanding membership fees.

j) Without the restriction of other legal means, the ISL may immediately issue a warning with or without previous notification, temporarily interrupt, block indefinitely and/or completely terminate the access and use of the site, keep the account balance, temporarily or indefinitely block the account and possible disbursements, keep bonuses and gains and terminate the agreement if one of the following requirements have been met:

i) The ISL considers that the user has violated a provision of these general terms and conditions or principles, guidelines or rules that are indicated to be part of the general terms and conditions;

ii) The user has missed the due date for the payment of an outstanding amount;

iii) The ISL is not able to confirm or authorize the information provided by the user;

iv) The ISL considers that the activities may bring about liability claims against the user, its users or the ISL;

k) The ISL decides to stop the business activities or to end the operation of ISL otherwise or in parts.

l) If the ISL closes the user account for reasons it is not responsible for, the user’s account balance shall not be refundable and will expire.

m) The user ensures that neither the ISL nor any third party acting in the name of the site shall be liable towards the user in regards to the termination of membership or access to the site. Moreover, the user guarantees not to attempt to reregister without written authorization as a member after the account has been closed by the ISL.

n) If the ISL decides to stop the business activities or to end the operation of ISL otherwise or in parts, the ISL may terminate this agreement and pay out a possible remaining balance on the account less any costs or fees attributable to the user account. The membership is invalid wherever it is not permitted.

o) Security check: In order to ensure a high degree of security and integrity, the ISL reserves the right to carry out a security check at any time in order to check the user identity, age and registration data. In order to facilitate these security checks, the user must provide such information or verifications upon request of the ISL. If a satisfying response has not been provided to the ISL until a deadline specified on the site, it will be considered an essential violation of these general terms and conditions.

7. Taxes, dues and fees:

The user carries the sole responsibility for all applicable taxes, dues and fees in connection with possibly awarded amounts or prices.

8. Termination/ Expiration of the contract

The contract between the ESL and the user may not be terminated during the season. It ends with the termination by one of the parties but no earlier than after the end of the current season.

9. During and/or after the registration of a team by the user, the data will be send to the poker software PokerRoom.com so that the team can be registered with the poker system and that the team, if adhering to the time frame and guidelines, may participate in the coming season.

10. Links and linking

The user acknowledges that some websites which are linked with the ISL are owned and operated by third parties and he agrees that the ISL is not responsible or liable for the availability of such external websites and resources and that it neither checks nor approves them and that it not liable for contents, advertisements, services, products or other material that can be found or that are available on such websites or resources. Moreover, the user acknowledges and agrees that the ISL is neither directly nor indirectly responsible for possible damages or losses that have resulted or are suspected to have resulted from or in connection with the use of or trust in such contents, goods or services provided by third parties and available on or through such websites. If the user decides to visit such a third party website, he will do so at his own risk and will be subject to the general terms and conditions and data protection guidelines published there. In addition, he acknowledges that the use of a website which is controlled, operated or owned by a third party is regulated by the general terms and conditions for the use of that website and not by these general terms and conditions. The user of the site knows that the eSport Online Ligen GmbH is responsible for the technical implementation of the ISL as well as the daily and technical operation of the ISL. The owner of the ISL is the Ongame Network Ltd based in Gibraltar.

Hereby, the user assures to hold the ISL harmless for all claims for compensation and liabilities that may result from the use of links provided on the site. The ISL reserves the right to delete links or linking programs at any time.

11. Copyrights

a) All material found on the website, especially the texts graphics, photos, video and audio clips, music, soundtracks, button symbols, streaming data, animations, pictures, downloadable material, data compilations and software is the intellectual property of the ISL or third parties who made them available to the ISL. The ISL reserves all rights, titles and interests regarding this material.

b) The material may not be copied, distributed, republished, altered, uploaded, posted on the Internet or transmitted in any way without the prior written consent of the ISL. The only exception is that the user may print a copy of the materials exclusively for his own private use. The user may not remove, alter or cause to be removed or altered, any copyright, trademark, service mark or any other proprietary notice or legend appearing on any of the materials.

c) The copyright for published objects created by the ISL lies with solely with the ISL. A reproduction or release of such graphics and texts in other electronic or printed publications or in verbal form requires the express agreement of the ISL. The ISL allows everyone to reference the pages of the ISL from his/her own pages as long as there is no monetary benefit or profit to be made.

d) The User has the possibility, to add a logo to his profile and display this logo publicly. The user has to make sure that the logo being used does not violate copyright or privacy law. Violations against this restriction will be avenged by immediate elimination of the user account. Judicial consequences as well as follow-up costs that might result out of such violations must be paid by the user.

12. Liability

The ISL will be liable for physical or financial loss only in case of intent of its legal representatives or assistants. In case of damage caused by negligence, the ISL is liable only as far as imperative legal standards allow for it. The ISL is not liable for slight negligence. The liability in case of the transfer of a guarantee, because of malice, for personal injury and according to the Product Liability Act remains intact.

13. Offset

The user and/or the team may only offset undisputed or legally determined counterclaims against ISL receivables.

14. Exploitation rights and other protection rights

If the user and/or the team is entitled to copyrights or other protection rights within the scope of the participation in the eSports-Poker League and championship system of the ISL, the user and/or the team shall transfer the exclusive usage rights and exploitation rights for all media to the ISL. In particular, this applies to the demos and screenshots of the league games as well as to the broadcasting rights of these games on TV, radio or via audio or video streams in the Internet. Demos are files that can be created by the game software in order to record the course of the game and to play it back later. In this regard, the user and the teams abandon their right to be named as the (co-)originator and to charge fees. The user agrees to have his passport photo that he sent with his registration to the ISL published on the ISL website for the purpose of introducing the individual players and teams on the website. Furthermore, the user and the team agree that the ISL is allowed to use the team names and/or the created logo(s), texts etc. completely and free of charge for all media for the purpose of advertising and associated software platforms.

15. Forums

If offered by the ISL on the www.esport-poker.com website, discussion forums or chats („forums"), the contents exchanged in these forums are not subject to any controls by the ISL. Thus, the ISL will not be liable for the contents placed in those forums. The user undertakes not to place any contents, software or other material into the forums that violate legal or official provisions, in particular those of a pornographic, insulting nature, content that glorifies violence or war or those that violate applicable regulations for the protection of youth or penal laws or may affect other ISL players (e.g. through viruses). The ISL is entitled to exclude a user from using the forums anytime if he has violated his aforementioned duties or if other legitimate interests of eSport-Poker League are affected. Furthermore, the user refrains from using insulting statements in such forums, whether they are directed against co-users, the ISL or third parties. The ISL may remove insulting and/or derogating contents at any time. The user agrees that the ISL may use the contents placed in the forums for the website, i.e. that the ISL publishes contents, saves them on the website, makes them publicly available, reproduces them when called up by other users of the website, changes, amends, edits, partially uses, removes and integrates the contents into other contents of the website as well as further utilizes the contents in connection with the website as well as in other media and on other websites.

16. Tournament rules

In addition to these general terms and conditions, general rules and guidelines apply to tournaments staged by the ISL.
Special rules may apply for certain tournaments in addition to these general terms and conditions and which will be announced by the ISL in connection with such tournaments.

17. General provisions:

Right to injunctive relief.
Both parties acknowledge that legal remedies may be inadequate to provide an aggrieved party with full compensation in the event of the other party’s breach, and that an aggrieved party shall therefore be entitled to seek injunctive relief in the event of any such breach, in addition to seeking all other remedies available at law or in equity.

18. Assignment

The rights and liabilities from these general terms and conditions cannot be assigned without the prior written consent of the partner. The ISL is entitled to transfer rights and liabilities from the terms and conditions to associated companies in the sense of §§ 15 ff Companies Act.

19. Attorney’s fees

In the event any party shall commence any claims, actions, formal legal actions, or arbritation to interpret and/or enforce these terms and conditions, or relating in any way to the relationship between the parties, the prevailing party in any such action or proceeding shall be entitled to recover, in addition to all other available relief, its reasonable attorney’s fees and costs incurred in connection therewith, including attorney’s fees incurred on appeal.

20. Data protection

Registration data and other information about the user and the use of the ISL and the services provided by the ISL will be collected and used according to our data protection guideline. You will find full information in the data protection guideline. The user expressly agrees that the ISL is allowed to forward information to associated companies in the sense of §§ 15 ff Companies Act.

21. Court of jurisdiction and applicable law

These general terms and conditions (including the principles, guidelines and rules that are part of this document by reference) and the relation between the user and the ISL are regulated and interpreted according to the laws of Gibraltar, notwithstanding the principles in terms of conflict of laws. The user agrees to settle possible conflicts, disputes or claims that may result in connection with these general terms and conditions or the relation between the user and the site exclusively in the jurisdiction of the courts in Gibraltar.

22. Modifications and Severability clause

The ISL reserves the right to change from time to time any of the terms of use and to adapt them to the legal as well as technical developments. In case of an inefficacy of individual regulations of these general terms and conditions, the efficacy of remaining regulations remain intact. A provision will replace the inefficacious regulations that comes closest to the whole economic purpose of the inefficacious regulations.
